Terms and Conditions/Gender Policy

By registering to participate in EuroGames Bern 2023, you accept the following Terms and Conditions:

EuroGames Bern 2023 are organized by Verein EuroGames Bern, a non-profit association based in Bern, Switzerland (hereinafter referred to as «EGB»).

EuroGames® is licensed by the European Gay & Lesbian Sport Federation (EGLSF).

  1. Disclosure of personal Information

I understand that as part of the registration process of EuroGames Bern 2023, personal information will be collected by EGB and stored in accordance with Swiss legislation. I accept the collection, use and disclosure of my personal information for the purpose of enabling my participation in the sports, conference and cultural program of EuroGames Bern 2023 and for the purpose of receiving information related to my participation in this event from EGB in the form of electronic newsletters, promotional flyers and other communication media.

I give my consent that EGB may disclose my personal information to any third parties that are involved in the organisation, on behalf of EGB, of EuroGames Bern 2023 and to European Gay & Lesbian Sport Federation and the European Same Sex Dance Association for the purposes of promoting EuroGames Bern 2023 and to promote future events of EGLSF’s member associations. I accept that my name could be published online for the purpose of tournament schedules, medal ceremonies and ranking lists. When registering, EGB gives participants the option of indicating a name they prefer to go by instead of their given name.

  1. Age Policy

The age limit for participation in EuroGames in 2023 is 18 years. Accordingly, participants must be 18 years old or older by July 26, 2023.

  1. Gender Policy

EGB affirms and supports the rights of athletes to compete as their true selves and to compete in the gender category that accords with their gender identity.

Male categories are open to everyone, female categories are open to all who identify as female and nonbinary categories are open to all who identify as nonbinary.

During the registration process, athletes are asked about their sexual and gender identity, and whether their gender identity is different to the gender they were assigned at birth. Please note that these are optional questions. The data helps us monitor inclusion, diversity and representation at EuroGames in 2023. Furthermore, we will use the data to create a push for greater inclusion in sports by proving that it is indeed possible.

  1. Health and Insurance

I declare that I am in a physically fit and healthy state which is required for participation in events of EuroGames in 2023 for which I am registering, and that I am not aware of any serious medical condition that would prevent me participating in these physical activities. For clarification, it is agreed that having been diagnosed as HIV positive is not considered a «serious medical condition» for the purposes of this clause.

If I sustain an injury or illness while participating in any role in EuroGames Bern 2023, I hereby authorise any medical or health personnel to perform and administer first aid medical treatment as deemed necessary and to seek more specialised medical attention at hospitals and health care institutions if deemed necessary by any first aid and medical staff or contractors of EGB.

I accept that it is my responsibility to organise my own travel insurance and personal insurance to cover my property and myself and possible damage to a third party for the whole period of EuroGames in 2023. I agree that I have hereby been advised to acquire adequate personal accident and health care insurance as a participant in any role in EuroGames in 2023.

  1. Liability

I acknowledge that I am fully aware of the risks and hazards inherent to participation in the different events of EuroGames in 2023. I acknowledge and agree that I have elected to voluntarily enter this agreement and to assume all risks of loss, damage and injury, including death, that I may sustain as a consequence of my participation in any of the sports or other events that I participate in. I hereby fully release EGB and EGLSF and all of its affiliated companies, sponsors, servants, agents, officers, directors, members, volunteers and employees from any claims, actions, suits or demands of whichever nature arising out of or related in any way to my participation in the events of EuroGames Bern 2023, including any loss, damage, injury or death sustained by any third party as a result, directly or indirectly, of my participation in the event. I hereby fully indemnify EGB and all of its affiliated companies, sponsors, servants, agents, officers, directors, members, volunteers and employees against all expenses, losses, damages and costs that they may incur as a result of my participation in the event.

  1. Rules and Regulations

I agree to abide by the rules and regulations of EuroGames Bern 2023 events as determined by EGB and governing bodies for sport and cultural events, including all written and verbal instructions given by EGB designated officials and event managers.

Applicable rules and regulations include – but are not limited to:

I agree that any failure to comply with the official instructions, rules and regulations of EGB or governing bodies for sports, conference and culture events may result in immediate disqualification from events or from the games.

I accept that the decisions of EGB and EuroGames in 2023 tournament officials are final.

EGB reserves the right to have designated officials reclassify sports, cultural event and conference participants where the registrant has self-selected a grade, level, category, division or other classification. EGB reserves the right to combine or eliminate grades, levels, rounds, event lengths, categories, divisions, or other classifications if deemed necessary at EGB’s complete and sole discretion.

I am aware that some venues or locations may have restricted accessibility or restrictions to serve special needs. EGB is committed to make sports, politics and culture accessible for everyone where possible. EuroGames Bern 2023 will follow local legislation and aim for a fully accessible event independent of any special needs or disabilities.

  1. Cancellations and Refund Policy

Venues, competition days and schedules of events may be changed or cancelled at EGB’s absolute discretion, after which EGB may decide to provide a refund of registration fees. In the event that EGB cancels the entire event, or parts of the event, for any reason whatsoever, I agree that I will have no claim or take no action against EGB in respect of any loss, damage or expenses incurred by me as a result of such cancellation, and I accept and agree that I will only be entitled to a partial refund of the registration fee.

Cancellations must be notified in writing.

  • Cancellations received up until 1 week after the date of registration will receive a 80% refund. This refund policy is valid until 31 May 2023.
  • Cancellations received up until 31 December 2022 will receive a 50% refund. Unless the cancellation is received up until 1 week after the date of registration. In this case, a refund of 80% will be granted.
  • No refunds will be issued for cancellations after 31 December 2022. Unless the cancellation is received up until 1 week after the date of registration. In this case, a refund of 80% will be granted.
  • No refunds will be issued for cancellations after 31 May 2023 regardless of date of registration.

In case the organisation is compelled to cancel all activities related to the event EuroGames Bern 2023 due to «Force Majeure», participants will receive a 50% refund.

In case the organisation is compelled to cancel a specific sport as part of EuroGames 2023 because of a lack of participants, participants will be offered the choice between registering for another sport or withdrawing their participation. In the latter case, they receive a 100% refund.

  1. Outreach

I accept that some participants of EuroGames Bern 2023 may have their registration fee deducted or removed or gain other financial benefits as part of the Outreach programme. The criteria for gaining such benefits are based upon EGB’s Outreach Policy, which can be received from EGB and will be provided to all who apply for the Outreach programme.

  1. Trademarks and Branding

I agree not to make any unauthorised use of the logo or trademarks, including «EuroGames», «EuroGames Bern 2023», «EGLSF» or any variation on these, on personal or team uniforms/clothing, merchandise, or promotional material.

I agree not to act in a way that would harm or compete with or devalue EGB and European Gay and Lesbian Sport Federation, EGLSF sponsors’ rights regarding branding potential, logo rights, exclusive presence, etc. at venues where events are being held. If at any time during the event, officials designated by EGB determine, at their sole discretion, that my actions may result in the devaluation of said sponsor rights or competes with the event sponsors, I will be required to immediately cease such action, including the removal of any uniforms, signs or other items that compete with sponsor or potentially devalues such sponsorship.

  1. Promotional Material

I hereby grant EGB the unconditional right to use, at its discretion, photographic pictures of myself in any form of media, art, advertising, trade, visual documentary, promotional material, merchandise or film coverage of any kind without compensation to me or approval by me. I will not make any unauthorised reproductions or copies of EuroGames Bern 2023 logo or likenesses without written permission from EGB.

  1. Applicable Law

Any dispute arising out of or in connection with EuroGames Bern 2023, including any disputes regarding the existence, validity or termination thereof, will be subject to Swiss law. Venue for jurisdiction for any disputes arising from the contractual relationship shall be Bern, Switzerland.
